(1) If any dispute arises between the Government of Nepal or the parties participating in the privatization in any matter mentioned in the agreement regarding privatization, such dispute shall be resolved by the parties concerned through mutual discussion.
(2) If the dispute cannot be resolved according to sub-section (1), such dispute may be resolved through arbitration with the consent of both parties. In this way, when solving the dispute through arbitration, it will be done in accordance with the prevailing law on arbitration or the prevailing arbitration rules of the United Nations Commission on International Trade Law (UNCITRAL).
(3) The place of arbitration shall be Kathmandu and the prevailing laws of Nepal shall apply to the arbitration.
